Following negotiation with the Defendants insurers, we have successfully concluded a recent claim, the facts of which were that the client was at work when an accident occurred. He was working in a timber yard and hadn’t been properly trained to use the saw. He had been asked to make a cut which was too thin for the machine but as he hadn’t been shown this, he attempted the cut, and his hands came into contact with dangerous parts of the machinery namely the saw. He sustained cuts and gashes to his hands and fingers and required immediate medical attention.
Luckily the employer accepted liability and accepted that the client had not been sufficiently trained and we were able to obtain all of his medical records and have him examined by a hand surgeon. The client also had psychiatric injuries, so he was examined by a psychiatrist and reports prepared.
Those reports then allowed us to value the claim and attempt settlement. As part of the claim the client was able to claim damages for pain and suffering but also for his out-of-pocket expenses. He hadn’t been paid in full whilst he was off, so he was able to claim those expenses back. He had also incurred travel expenses and his family had to provide care and assistance to him.
